Booking Terms & Conditions

Please take the time to read and understand the conditions of booking set out below prior to booking a tour or transfer with us. We strongly recommend that you also read the relevant information relating to your tour prior to booking to ensure that you understand the itinerary, style and physical demands of the trip you are undertaking.

1. Our Contract

All bookings are made with Airlie Beach Adventure Tours – (ABN 63 077 424 779). By booking a tour or transfer with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.

2. Validity

Dates and itineraries are valid from 01 April 2020 to 31 March 2021. Beyond 31 March 2021 dates and itineraries are indicative only.

3. Payments

You are required to pay the full amount at the time of booking.

4. Acceptance of booking and final payments

Once we accept your booking or transfer we will issue a confirmation invoice.

A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 7 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the tour price is due 7 days before the departure date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled.

5. Prices & surcharges

Our tour and transfer prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our tour and transfer prices may vary at any time in accordance with demand, market conditions and availability that time. a cheaper price, full cancellation conditions apply. The most up to date pricing is available on our website.

6. Your details

In order for us to confirm your tour or transfer arrangements you must provide all requested details. Necessary details vary by tour or transfer however they include but are not limited to full name, date of birth, residential address and any pre-existing medical conditions you have which may affect your wellbeing whilst with us.

All children under seven years of age must be secured in a child restraint or booster seat when travelling in a vehicle. Please notify us immediately if a child seat is required.

7. Cancellation by the traveller

Cancellations with less than 48 hours’ notice or a no show will incur a fee of 100% of the total tour or transfer price plus the cost of any pre booked catering options, which shall be debited against the credit card provided at the time of booking.

Cancellations with more than 48 hours will incur the forfeit of the booking fee however customers will be given the opportunity to reschedule at no additional costs.

Alterations can be made to departure dates and times at no cost up until 24 hours prior to the tour or transfer.

If you are required to cancel your reservation due to COVID-19 Government mandated travel restrictions, you will be issued a full refund.

8. Cancellation by us

Whilst we will make every effort to ensure your tour or transfer proceeds as scheduled we may cancel at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary.

We will make every effort to get you to your destination safely, comfortable and on time. However, occasionally, allowances must be made for unforeseen circumstances such as traffic, road weather conditions, illness, vehicle breakdown etc. We cannot assume responsibility for circumstances beyond our control.

Airlie beach Adventure Tours reserves the right to substitute vehicles of a similar category where necessary. Should there be a vehicle breakdown or mishap rendering the reserved vehicle out of commission, we reserve the right to substitute a vehicle / vehicles. We will make every effort to supply an alternative vehicle.

Should we be unable to provide an alternative vehicle of if we cancel your trip you will receive a full refund.

9. Booking amendments

If you wish to make modifications to your tour or transfer you must you must notify us at least 48 Hours prior to the proposed departure date. A fee of $120.00 per tour booking and $50.00 per transfer booking may apply subject to a review of the circumstances.

10. Waiting time

We will always endeavour to accommodate our clients who require excess time with our vehicles. Where possible, the vehicle will be made available for as long as possible after the specified period of your reservation. Waiting / over time will be charged in 15 minute increments as per our standard fees.

11. Vehicle Damage or Bad Behaviour

If you or any person or part of your party damage or soil our vehicle, interior or exterior, including all fittings and fixtures, you will be liable for all costs incurred to rectify said damage.

If you are any person or part of your party behave in a manner deemed unsafe, crass or damaging to any part of your party is considered intoxicated, before, after or whilst en route, we reserve the right to terminate your reservation and evict you from the vehicle. In the event this occurs, no refund will apply.

Seat belts must be worn at all times and vehicles cannot be loaded beyond seating capacity.

12. Smoking

Smoking is strictly prohibited in all of our vehicles.

13. Food Consumption.

No food of any description is to be consumed inside our vehicles. If included in your package, your host will serve any food once the vehicle has stopped and passengers alighted unless otherwise specified.

14. Travel insurance

We strongly advise travel insurance for all your holiday or travel bookings to meet your personal requirements in respect to personal injury, illness, employment changes or weather conditions.

15. Alcohol

Airlie Beach Adventure Tours practices the responsible service of alcohol and operate under Liquor Licence 217759
Commercial Other - Subsidiary Off Premises, hence BYO alcoholic beverages are not permitted

Alcoholic beverages may only be sold to, supplied and consumed by persons over the age of 18 and full responsibility is assumed by the traveller. We will not be held responsible nor liable for you or any part of your party consuming alcohol nor the consequences that may ensue, including but not limited to any municipal or state penalty infringement notice and/or associated fines. All alcohol consumption is your responsibility and at your own risk and you alone shall assume full liability.

All illegal materials and substances are strictly prohibited from our vehicles.

16. Acceptance of risk

While every effort is made to minimise risks it is a necessary part of modern adventure tour operations to ensure that participants are made fully aware and accept the inherent risk involved in undertaking activities in the outdoors. You acknowledge that the nature of the tour is adventurous and participation involves a degree of personal risk and we will therefore ask read and sign an acceptance of risk form before the tour commences. document carefully and understand it thoroughly before signing.

17. Limitation of liability

In all cases, Airlie Beach Adventure Tours maximum liability shall be limited to a full refund of monies paid pertaining only to the trip in question. In every case, we will not be liable, whether in tort, in contract or otherwise for any accident, delay, injury, irregularity, loss or damage to persons or property of any kind whatsoever and howsoever arising (included but not limited to any negligence or breach of contract by Airlie beach Adventure Tours) caused or included during, or in relation to the carriage of any passenger or provisions of services. All care will be taken by us, but no liability will be assumed. No claim for Liquidated Damages, Consequential Loss, or any other shall be admissible. The above provision shall be read subject to any implied terms, conditions or warranties imposed by the Trade Practices Act 1974 or any other Commonwealth or State legislation in so far as such may be applicable and prevent either expressly or implied exclusion or modification of any such term, condition or warranty.

18. Optional activities

Optional activities at various locations we may visit are not included in the tour price and do not form part of the tour or this contract. You accept that any assistance given by your tour driver or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.

19. Lost or Damaged Property

Please check for personal belongings thoroughly before exiting the vehicle. If items are left inside the vehicle, you are welcome to collect them from our depot. If the vehicle is required to return with the item, a fee will be calculated and charged based upon the particular vehicles hourly rate. We will not be held responsible for any loss or damage to any personal belongings.

20. Claims & complaints

If you have a complaint about your tour please inform the tour driver or our office management team at the time so that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.

21. Photos and marketing

You consent to us using images of you taken during the tour / transfer for advertising and promotional purposes in any medium we choose. Unless otherwise agreed grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes

22. Privacy policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a tour / transfer or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the tour or transfer. We will otherwise treat your details in accordance with our privacy policy.

23. Insurance

Please note our Insurance policies cover our passengers whilst inside our vehicle/s and en route to designated destination.

24. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

25. Applicable law

The laws of Queensland, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Queensland, Australia
